These Terms of Service (the “Terms”) govern your access to and use of the Catholic Film Database website, applications, APIs, and any related services (collectively, the “Service”) operated by Catholic Film Database(“we,” “us,” or “our”). By creating an account, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
You must be at least 13 years old to create an account. If you are between 13 and the age of majority in your jurisdiction, you may use the Service only with the involvement of a parent or guardian who agrees to these Terms on your behalf. Some features (including the FilmMakers Pro, Critic, and Investor sections) may require you to be 18 or older. By using the Service you represent that you can form a binding contract under applicable law.

We may suspend, restrict, or terminate accounts that violate these Terms or pose risk to other users, the Service, or third parties, with or without notice.
“User Content” means anything you submit, upload, post, or otherwise make available through the Service — including reviews, ratings, forum posts, comments, lists, pitches, project descriptions, profile information, images, videos, attachments, and direct messages.
You retain all ownership rights in your User Content. By submitting User Content, you grant Catholic Film Database a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, modify (for formatting), adapt, publish, translate, distribute, perform, and display the User Content for the purposes of operating, providing, improving, promoting, and marketing the Service. This license continues for any User Content that remains on the Service after you delete your account (e.g., a forum reply that is part of a public thread), but ends for any content you remove or that is removed at your request, subject to backup retention and applicable law.
You represent and warrant that (a) you own or have the necessary rights to your User Content, (b) the User Content does not infringe any third party’s rights, and (c) the User Content complies with these Terms and applicable law.
We may, but are not required to, review User Content. We reserve the right (but not the obligation) to remove, edit, or refuse any User Content at our sole discretion, with or without notice, including for violations of these Terms.
You agree not to use the Service to:
Certain user designations on the Service — including “Verified Catholic,” “Critic,” “FilmMakers Pro,” “Parish Verified,” and similar labels — reflect a baseline review by us of submitted documentation or credentials. These designations are not endorsements of any individual, their work, their orthodoxy, or their fitness for any particular purpose. We do not guarantee the accuracy of any user’s self-described credentials, affiliations, or professional history.
Connections initiated through FilmMakers Pro (including collaboration requests, job postings, messaging, and project participation) are direct relationships between users. We are not a party to those relationships and are not responsible for the conduct, communications, or obligations of any user toward another.
The Service includes features that allow filmmakers to post project pitches and investors to express interest in those pitches (collectively, the “Investor Features”). The Investor Features are an informational and introductory service only.
Catholic Film Database is not a broker, dealer, investment adviser, investment banker, underwriter, finder, or financial intermediary. We do not provide investment advice, financial advice, accounting advice, legal advice, or tax advice. We do not endorse, recommend, or evaluate any pitch, project, or investment opportunity. Nothing on the Service constitutes an offer or solicitation to buy or sell any security or investment product.
Any investment in a film project carries risk, including the risk of total loss. Investors are solely responsible for their own due diligence, including verifying the identity, credentials, financial condition, and representations of any filmmaker or project, and for complying with all applicable securities laws (including Regulation D, Regulation Crowdfunding, blue sky laws, and accredited investor verification where required). Filmmakers are solely responsible for the truthfulness and completeness of their pitches and for compliance with all laws applicable to soliciting capital.
We strongly encourage all users of the Investor Features to consult independent legal, financial, and tax advisors before entering into any transaction.
Our content. The Catholic Film Database name, logo, wordmark, visual design, original written editorial content (including reviews, discussion guides, content guides, and curated lists authored by our team), and the software, code, and structure of the Service are owned by Catholic Film Database or our licensors and are protected by copyright, trademark, and other laws. Except as expressly permitted by these Terms, you may not copy, reproduce, modify, distribute, sell, lease, or create derivative works of any portion of the Service.
Third-party content. Film titles, posters, key art, trailers, cast and crew information, plot summaries, and related metadata displayed on the Service are the property of the respective rights holders. We surface this material under license (including the TMDB API license) and/or fair use for purposes of review, commentary, criticism, news reporting, scholarship, and catechetical education. Display of this material on the Service does not transfer any rights to you. The Catholic Film Database uses the TMDB API but is not endorsed or certified by TMDB.
Feedback. If you submit feedback, suggestions, ideas, or proposed improvements to the Service, you grant us an unrestricted, irrevocable, royalty-free license to use that feedback for any purpose, without compensation or attribution.
We respect the intellectual property rights of others and respond to clear notices of alleged infringement in accordance with the Digital Millennium Copyright Act (DMCA). If you believe that material on the Service infringes a copyright you own or control, please send a written notice to our designated DMCA agent that includes:
Send notices to: dmca@catholicfilmdb.com. Notices that do not substantially comply with 17 U.S.C. § 512(c)(3) may not be effective. We may share notices, including identifying information, with the alleged infringer and may publish them in redacted form. We reserve the right to terminate accounts of repeat infringers in appropriate circumstances. A counter-notification procedure is available under 17 U.S.C. § 512(g) for material removed in error.
The Service may contain links to third-party websites, services, or content (including streaming platforms, news sources, parish organizations, and professional directories) that are not owned or controlled by us. We do not endorse and are not responsible for the availability, accuracy, content, practices, or policies of any third-party service. Your use of any third-party service is at your own risk and subject to that service’s terms.
The Service is provided “as is” and “as available” without warranties of any kind, express or implied. To the maximum extent permitted by applicable law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing or usage of trade.
We do not warrant that the Service will be uninterrupted, secure, or error-free; that catalog data, ratings, reviews, or recommendations are accurate, complete, or current; or that any specific results will be obtained from use of the Service. User discretion is advised at all times. Ratings and content guides are editorial opinions, not medical, psychological, theological, or legal advice.
To the maximum extent permitted by applicable law, in no event will Catholic Film Database, its officers, directors, employees, contractors, agents, affiliates, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, data, or goodwill, arising out of or related to your use of or inability to use the Service, even if advised of the possibility of such damages.
Our aggregate liability for all claims arising out of or related to the Service will not exceed the greater of (a) the total amount you paid to us in the twelve months preceding the event giving rise to the claim or (b) one hundred US dollars (US $100). Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions, our liability is limited to the maximum extent permitted by law.
You agree to defend, indemnify, and hold harmless Catholic Film Databaseand its officers, directors, employees, contractors, agents, affiliates, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to (a) your User Content, (b) your use of or access to the Service, (c) your violation of these Terms, (d) your violation of any third-party right, including intellectual property, publicity, or privacy rights, or (e) any dispute between you and another user of the Service.
You may terminate your account at any time by using the in-app account-deletion flow or by emailing legal@catholicfilmdb.com. We may suspend or terminate your access to all or part of the Service at any time, with or without notice, for any reason, including for violations of these Terms, suspected fraudulent or abusive activity, or as required by law.
Sections that by their nature should survive termination — including sections on User Content licenses, intellectual property, disclaimers, limitation of liability, indemnification, and governing law — will survive.
These Terms are governed by the laws of [YOUR STATE], without regard to conflict of laws rules. You and we agree that any dispute, claim, or controversy arising out of or related to these Terms or the Service will be resolved exclusively in the state or federal courts located in [YOUR STATE], and you consent to the personal jurisdiction of those courts.
Before filing any legal action, you agree to first contact us at legal@catholicfilmdb.com and attempt in good faith to resolve the dispute informally for at least sixty (60) days. Nothing in this section prevents either party from seeking injunctive or other equitable relief to protect intellectual property rights.
We may update these Terms from time to time. Material changes will be communicated by updating the “Last updated” date above and, where appropriate, by a notice on the Service or by email. Your continued use of the Service after the effective date of any update constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, stop using the Service.
Entire agreement. These Terms, together with the Privacy Policy and any other policies referenced here, constitute the entire agreement between you and us regarding the Service.
Severability. If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.
No waiver. Our failure to enforce any provision does not waive our right to enforce it later.
Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
